Cigars Plus Terms and Conditions
By signing up for the Cigars Plus service, you agree to the following Terms and Conditions.
1. The initial membership rate to join Cigars Plus is $44.95 per year. The Cigars Plus membership will automatically renew every year on your anniversary date. You can log into your account and update your payment information at any time. The Cigars Plus membership is non-refundable except as set forth in these Terms and Conditions.
2. Membership in Cigars Plus is valid for a twelve-month period. You need a registered Cigars.com customer account to subscribe, and you must checkout using such registered customer account. Registration at Cigars.com is limited to adults 21 years of age and older.
3. During the initial membership year, as long as you have not yet used the service, you can cancel your Cigars Plus membership within 14 days of signing up by contacting Customer Service by phone at (888) 574-3576 or by email at customerservice@cigars.com. A full refund of your membership fee will be issued if you have not made any eligible purchases using the Cigars Plus service. Cancellations during any renewal year are addressed below in Paragraph 4.
4. If you cancel your membership after making an eligible purchase, you will not receive a refund of any portion of your annual membership fee.
5. Cigars Plus by Cigars.com is only available for shipping to U.S. mainland addresses and entitles you to free standard shipping. For additional shipping restrictions, please visit https://www.cigars.com/shipping-info.html. There is no limit to the number of orders you may place. For a pre-paid Return Shipping Label, please call Customer Service, and one will be mailed to you.
6. Violation of any of these Terms and Conditions will result in termination of your membership, and no refund will be issued.
7. Cigars.com reserves the right to accept or refuse membership and to make changes to these Terms and Conditions at our discretion, without notice. You may review the current Terms and Conditions for Cigars Plus at www.Cigars.com. If any change to these Terms and Conditions is found invalid, void, or unenforceable for any reason, that change is severable and does not affect the validity and enforceability of any remaining changes or terms. Your continued membership after Cigars.com changes these Terms and Conditions constitutes your acceptance of the changes. If you do not agree to any changes, you must cancel your membership. Large orders may incur additional shipping fees. Shipping charges are subject to change based on quantity and weights.
8. All other Cigars.com Legal Terms and Conditions apply. Please review Cigars.com Terms of Use and Privacy Policy, and if you are a California resident, please review our CA Privacy Policy.
9. Cigars Plus by Cigars.com is for personal use only and is not intended for trade customers who purchase goods for business, re-sale or wholesale purposes. You may not transfer or assign your Cigars Plus membership or any benefits thereunder to any other person.
10. Cigars.com may terminate your Cigars Plus membership in our discretion without notice. If we do so, we will issue you a prorated refund based on the number of full months remaining in your membership year. However, we will not issue any refund for a termination related to conduct that we determine, in our sole discretion, violates these Terms and Conditions or any applicable law, involves fraud or misuse of the Cigars Plus membership, or is harmful to our interests. Our failure to insist upon or enforce your strict compliance with these Terms and Conditions will not constitute a waiver of any rights.
11. IN ADDITION TO OTHER LIMITATIONS AND EXCLUSIONS IN CIGARS.COM’S CONDITIONS OF SALE, IN NO EVENT WILL WE OR OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR OTHER REPRESENTATIVES BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, ARISING OUT OF OR RELATED TO CIGARS PLUS. OUR TOTAL LIABILITY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WILL NOT EXCEED THE LAST ANNUAL MEMBERSHIP FEE YOU PAID. THESE EXCLUSIONS AND LIMITATIONS OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND WILL SURVIVE CANCELLATION OR TERMINATION OF YOUR PRIME MEMBERSHIP. CERTAIN STATE LAWS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.
